1. Agreement

1.1. TREVEX Technology Limited is a company registered in the Dubai International Financial Centre under registration number 5069, with its registered office at Unit GA-00-SZ-L1-RT-201, Level 1, Gate Avenue, South Zone, Dubai International Financial Centre, Dubai, United Arab Emirates (“TREVEX”, “we”, “us”, “our”). TREVEX is registered in the DIFC. It is not regulated by the Dubai Financial Services Authority, and the directory is not a regulated financial service.

1.2. TREVEX owns and operates the website at trevex.io and its content (the “Site”). By accessing or using the Site, you agree to these Terms and Conditions of Use (the “Terms”), which take effect from the moment you use the Site. Please read them carefully.

1.3. These Terms are a legal agreement between you, the user of the Site (“you”, “your”), and TREVEX. If you do not agree to them, please do not use the Site.

1.4. We may change these Terms from time to time under clause 17. By continuing to use the Site, you agree to the current version.

1.5. If you order any product or service from the Site on a pay-as-you-go basis, take out Membership, or use the Claim and Verification options, these Terms continue to apply.

2. The Site and the directory

2.1. The Site is the UAE Business Directory. It holds business information, where users can find businesses and the professional information of the people connected to them, including shareholders, directors, managers, and others involved in a business. We store and maintain this directory and make it available to users.

2.2. Every UAE business has a free Listing. A business can Claim its profile, become a Member, and complete Verification to become a Verified Member. We provide information and services on a pay-as-you-go basis, through Membership, or as one-off services, and we offer tailored enterprise solutions where those options do not fit.

2.3. We compile the directory from information provided by users and businesses, and from public registries, authorities, events, introductions, and selected business-information providers. Users may be individuals or businesses, and may need to register and pay to access some features.

4. Use of the Site

4.1. All content on the Site, including text, materials, graphics, logos, icons, images, video and audio, trademarks (registered or not), layout, the user interface, and the look and feel (the “Content”), is provided for you to browse the Site and use its services.

4.2. The Site is for finding and managing business-directory records and using our services. Use it only for those purposes.

4.3. You are responsible for any costs you incur in using the Site.

4.4. We do not promise the Site is appropriate or available outside the United Arab Emirates. If you use it from elsewhere, you do so on your own initiative and are responsible for local compliance.

4.5. As a condition of using the Site, you agree not to:

(a) reproduce, modify, publish, transmit, sell, distribute, perform, display, or exploit any Content except as these Terms expressly allow;

(b) scrape, crawl, harvest, bulk-download, extract, copy, mirror, or re-use the directory or any substantial part of it, or use any automated means to access or collect Content, without our written permission;

(c) use the Site in breach of any law or regulation;

(d) infringe the intellectual property, privacy, or other rights of TREVEX or anyone else;

(e) access data not intended for you, or log into an account or server you are not authorised to use;

(f) probe, scan, or test the vulnerability of any system or network, or breach security or authentication measures;

(g) use the Content to impersonate any person or misrepresent your affiliation with TREVEX or anyone else;

(h) use the Content to send unsolicited communications;

(i) introduce any virus, malware, or harmful code, or interfere with the proper working of the Site; or

(j) decompile, disassemble, or reverse engineer any part of the Site.

4.6. We may suspend or prevent your access to the Site if you breach these Terms or any law.

5. Registration

5.1. You can access most of the Site without registering. Some features, in particular Claiming a business, Membership, and Verification, require an account.

5.2. Each registration is for a single user. Do not share your login credentials.

5.3. We are not obliged to accept any registration and may refuse, suspend, or terminate an account at any time.

5.4. You are responsible for keeping your credentials secure and confidential.

5.5. If we believe there is a security risk or misuse, we may require you to change your password, or suspend or terminate your account.

5.6. Any personal data you provide is handled in line with our Privacy Policy.

5.7. You are responsible for ensuring the information you provide is true, accurate, and not misleading, and is not used to commit fraud. We are not liable for inaccuracies in information provided by users or obtained from other sources, or for information that ceases to be accurate over time.

6. Payment

6.1. For services on a pay-as-you-go basis, through Membership, or as one-off services, these Terms apply unless we tell you otherwise in writing.

6.2. Membership is AED 999 per year. We bill in UAE Dirham (AED), or another currency we make available, plus applicable taxes including VAT, and charge your payment method when you subscribe or purchase, unless the ordering terms say otherwise.

6.3. If your payment or registration information is not accurate, current, and complete, and you do not update it promptly, we may suspend or terminate your account and refuse service.

6.4. If you do not update a payment method (for example an expired card), we and our payment providers may contact your card provider to update it, and you authorise us to continue billing with the updated information.

6.5. We renew Membership and other recurring subscriptions automatically at the then-current rate, unless cancelled or terminated under these Terms.

6.6. Authorised refunds are made in the original form of payment.

6.7. On cancellation, you keep full access until the end of the paid term. After that, access is limited, and we are not responsible for preserving data lost as a result. There are no refunds on cancellation.

7. Accessing information from the Site

7.1. TREVEX owns and operates the Site and provides business information. We are not a commercial agent and do not endorse any business in the directory. Businesses appear voluntarily or are compiled from the sources in clause 2.3. We are not party to, and accept no liability for, any communication or transaction between users.

7.2. The directory is provided in good faith. We do not actively verify information submitted by users, except where Content is expressly marked as Verified. You are responsible for your own enquiries, and we give no guarantee and accept no responsibility for the accuracy or completeness of Content unless it is expressly marked Verified.

7.3. Content marked as Verified reflects a confirmation made at a point in time against the sources we checked. It is not a continuing guarantee of a business’s status, solvency, or conduct.

7.4. Content is not advice and should not be relied on as the sole basis for any decision. We disclaim liability for reliance placed on Content.

8. Submitting information to the Site

8.1. If you submit information to the Site, you:

(a) grant TREVEX a royalty-free, irrevocable, perpetual, worldwide, transferable, and sub-licensable licence to use, host, reproduce, modify, publish, edit, translate, distribute, perform, display, and create derivative works from that information, in whole or in part, on the Site and on any other service we operate, for the operation, promotion, and improvement of TREVEX and its products, and for the aggregated and derivative data products described in clause 10;

(b) warrant that you hold the rights in the information and are authorised to submit it, and have obtained all necessary licences and approvals;

(c) warrant that the information is accurate and not misleading;

(d) agree that information you submit for display is non-confidential and non-proprietary;

(e) agree not to submit anything unlawful or submitted for an improper purpose, including anything defamatory, misleading, obscene, offensive, infringing, or in breach of confidence or privacy;

(f) acknowledge that we are not obliged to monitor Content, but may review, edit, or remove it; and

(g) acknowledge the disclaimers and limitation of liability in these Terms, and that you are responsible for the accuracy and security of the information you provide.

8.2. The licence in clause 8.1(a) survives the closure of your account in respect of Content already published or already incorporated into aggregated or derivative data. This does not affect your statutory rights over personal data, which are dealt with in the Privacy Policy.

9. Privacy

9.1. We handle personal data in line with our Privacy Policy, which explains what we collect, how and why we use and share it, your rights, and how to contact us.

10. Intellectual property

10.1. The Site, the directory as a compilation, the underlying database, our software, trademarks, our credit ratings and scores, and the aggregated and derivative datasets, insights, and analytics we produce, together with all intellectual property in them (including copyright, database and compilation rights, trademarks, and design rights, whether registered or not), are owned by TREVEX and our licensors. We reserve all of these rights.

10.2. Nothing in these Terms grants you any rights in the Site or the Content beyond what you need to access it. You must not remove or circumvent any notice or security measure on the Site or the Content.

10.3. TREVEX trademarks may not be used without our prior written permission. Third-party trademarks belong to their owners.

10.4. We may remove accounts or Content used in breach of these Terms or that is unlawful, infringing, or otherwise inappropriate.

11. Hyperlinks and third-party sites

11.1. The Site may link to third-party sites and advertising. We do not control them and accept no responsibility for their content. A link is not an endorsement. Your use of a third-party site is at your own risk and subject to that site’s terms.

12. Links to the Site

12.1. You may link to the Site without our prior consent, provided the link does not frame our Content; imply an endorsement we have not given; use our trademarks or logos without permission; or sit on a site that breaches these Terms. We may require you to remove any link at any time.

13. Disclaimers and limitation of liability

13.1. The Site and the Content are provided “as is” and “as available”, with no warranties of any kind to the fullest extent the law allows. We disclaim all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, accuracy, completeness, title, non-infringement, and freedom from viruses.

13.2. We do not warrant that the Content is accurate, complete, current, or reliable, except where it is expressly marked as Verified, which is a point-in-time confirmation under clause 7.3. We do not warrant that the Site will be uninterrupted, secure, or error-free.

13.3. Credit Reports, assessments, ratings, and scores are opinions and risk indicators based on available information. They are not guarantees of creditworthiness or solvency, and not a recommendation to extend or refuse credit. You remain responsible for your own decisions.

13.4. To the fullest extent the law allows, TREVEX is not liable for any indirect, consequential, incidental, special, or punitive loss, or for loss of profit, revenue, data, goodwill, or business, arising from or connected to your use of, or inability to use, the Site or the Content, whether in contract, tort, statute, or otherwise.

13.5. To the fullest extent the law allows, our total aggregate liability arising from or connected to the Site, the Content, and these Terms, across all claims, is limited to the greater of the total fees you paid to TREVEX in the 12 months before the event giving rise to the claim, or AED 3,670.

13.6. Nothing in these Terms excludes or limits our liability for: fraud or fraudulent misrepresentation; death or personal injury caused by our negligence; any liability that cannot be excluded or limited under applicable law, including a data subject’s statutory right of action under the DIFC Data Protection Law; or our own wilful misconduct or gross negligence.

14. Indemnity

14.1. You agree to indemnify and hold TREVEX harmless from any claim, liability, loss, damage, cost, or expense (including reasonable legal fees) arising from or connected to: your use of the Site; your breach of these Terms; your violation of any law or third-party right; and any information you submit, including its accuracy, your right to submit it, and its non-infringement. We may require you to assist in the defence of any such claim.

14.2. We will indemnify you against any third-party claim that your permitted use of the Site infringes that third party’s intellectual property rights, except to the extent the claim arises from Content you submitted or your breach of these Terms.

15. Force majeure

15.1. We are not liable for failing to comply with these Terms because of circumstances beyond our reasonable control, including strikes, system or network failures, fire, flood, accident, and epidemics or pandemics.

16. Rights of third parties

16.1. No one other than a party to these Terms may enforce any of them.

17. Variation

17.1. We may vary these Terms from time to time. The updated Terms will be posted on the Site, and by continuing to use the Site you agree to them. Where a change materially affects how we use personal data, we will follow the notice and consent process in the Privacy Policy rather than rely on continued use alone.

18. Termination

18.1. We may restrict, suspend, or terminate your access to all or part of the Site at any time, for any reason, without prior notice or liability. We may change, suspend, or discontinue any feature, database, or Content at any time. Except as these Terms expressly state, we are not liable for any modification, suspension, or termination.

19. Breach

19.1. We apply these Terms at our discretion. If you breach them, we may terminate or suspend your use of the Site, remove or edit your submissions, disclose submissions or communications to law-enforcement authorities, or take any other action we consider necessary.

20. Disputes and governing law

20.1. We will try to resolve any dispute quickly. Please contact us first using the details in clause 3.

20.2. These Terms and your use of the Site are governed by the laws of the Dubai International Financial Centre, without regard to conflict-of-law principles. Any dispute is subject to the exclusive jurisdiction of the Courts of the Dubai International Financial Centre.
